Terms of Service

Effective Date: September 30, 2026

These Terms of Service ("Terms") form a legally binding agreement between you and Homie Lab Inc. ("Chunkr," "we," "us," or "our") governing your use of the Chunkr app, website, and related services (together, the "Service").

If you create an account or use Chunkr, you agree to these Terms. If you do not agree, do not use the Service.

Quick Read

Chunkr is for adults 18 and older only.
Your account must be truthful and used only by you.
You keep ownership of your content, but you give us a limited license to host and display it in the Service.
Harassment, scams, illegal activity, location abuse, and commercial solicitation are prohibited.
Optional Chunkr Ad-Free subscriptions renew automatically until canceled through Apple or Google. Deleting your account does not cancel billing.
Disputes are governed by Ontario law and may be subject to individual arbitration.

1. Eligibility

Age Requirement

You must be at least 18 years old to use Chunkr. By using the Service, you represent that:

you are at least 18 years old;
you have the legal capacity to enter into this agreement; and
you are not prohibited by law from using the Service.

Users Who May Not Use Chunkr

You may not use Chunkr if you:

are under 18;
have been previously banned from the Service;
are prohibited by law from using dating or social networking services; or
are otherwise ineligible under applicable law.

Adult Content Acknowledgment

Chunkr is an adult platform. By using the Service, you understand that:

you may encounter sexual or suggestive content;
private messages may involve explicit adult content between consenting adults; and
you are responsible for your decisions and interactions with other users.

2. Account Registration and Security

Accurate Information

You agree to provide accurate, current, and complete information and to keep it updated.

Account Security

You are responsible for:

protecting your login credentials;
all activity on your account; and
notifying us promptly of suspected unauthorized access.

One Account Per Person

Unless we expressly permit otherwise, you may maintain only one active Chunkr account. Accounts created for someone else or through automation are not allowed.

3. License to Use the Service

License Granted to You

Subject to these Terms, Chunkr grants you a limited, non-exclusive, non-transferable, revocable license to:

download and use the mobile app on your personal devices; and
access and use the Service for personal, non-commercial purposes.

Restrictions

You may not:

copy, modify, distribute, or create derivative works from the Service except as allowed by law;
reverse engineer, decompile, or disassemble the Service;
use the Service for commercial purposes without written permission;
sublicense or transfer your rights under these Terms; or
remove proprietary notices.

Intellectual Property

Chunkr and its branding, software, and service features are owned by Homie Lab Inc. or its licensors and protected by intellectual property law. These Terms do not give you ownership of the Service.

4. User Content

Your Ownership

You retain ownership of the photos, text, messages, and other content you upload or create on Chunkr ("User Content").

License to Chunkr

By submitting User Content, you grant Chunkr a worldwide, non-exclusive, royalty-free, sublicensable license to:

host, store, back up, and process the content;
format and display it in the Service;
use it for safety scanning, moderation, and abuse prevention; and
take technical steps necessary to operate the Service.

How Long the License Lasts

This license continues until the content is deleted, except that we may retain copies:

to comply with law;
for legitimate safety or abuse investigations; or
in backup systems for a limited retention period.

Your Promises About Content

You represent that your User Content:

belongs to you or you have the right to share it;
does not violate another person’s privacy or intellectual property rights;
does not depict anyone under 18; and
complies with these Terms and our other policies.

5. Prohibited Conduct

You agree not to use Chunkr to do any of the following.

Harm or Abuse

harass, threaten, stalk, bully, or intimidate anyone;
engage in hate speech or targeted discrimination;
share non-consensual intimate imagery;
doxx, blackmail, extort, or coerce another person; or
attempt to contact or exploit minors.

Deception or Fraud

impersonate another person or entity;
misrepresent your identity, age, or photos;
run scams, fraud, or phishing schemes; or
create fake or misleading accounts.

Location Abuse

attempt to determine another user’s exact location;
track or monitor users outside the intended experience of the Service; or
use location features to stalk, threaten, or harm someone.

Commercial Misuse

offer escorting or commercial sex work;
solicit money or gifts;
advertise or sell products or services without authorization; or
recruit users for outside services or schemes.

Illegal or Technical Abuse

post illegal content;
facilitate drug or weapons sales;
use bots, scraping, or automation without permission;
attempt unauthorized access to systems or accounts;
evade blocks, bans, or safety controls; or
upload malware or harmful code.

6. Safety and Moderation

Our Rights

We may, but are not required to, review content, investigate reports, remove content, restrict features, suspend accounts, or ban users who violate these Terms or other policies.

Automated Scanning

We may use automated tools to help identify:

prohibited imagery;
policy violations;
spam and fraud signals; and
other safety risks.

User Reports

We rely in part on user reports to identify harmful behavior. False or abusive reporting may itself violate our policies.

No Guarantee of Safety

Chunkr cannot verify the identity, intentions, or offline behavior of every user. You use the Service and meet other users at your own risk.

7. Location Features

Approximate Location

The Service may show approximate distance or map placement for discovery features. If you choose to send a location in chat, the recipient can see the location you shared, which may include precise coordinates, and open it in a maps app.

Your Responsibilities

You must not triangulate, infer, or otherwise attempt to determine another user’s exact location.

Risk Acknowledgment

Location-based products involve privacy and safety risks, especially in regions where LGBTQ+ identity may create legal or personal danger. Use these features cautiously.

8. Paid Features and Subscriptions

Chunkr Ad-Free

Where offered, Chunkr Ad-Free is an optional monthly or annual subscription that removes Chunkr's in-app advertising while your subscription entitlement is active. Both plans provide the same ad-removal benefit. It does not buy verification, preferential moderation, or an exemption from our community rules. Free access may include advertising. Available plans, local prices, billing periods, taxes, and any offer conditions are shown in the app and the store purchase confirmation before you agree to pay.

Billing and Automatic Renewal

Purchases are billed by Apple App Store or Google Play to the store account used at checkout. Payment is charged when you confirm the purchase. Subscriptions renew automatically for the selected billing period unless canceled before the store's renewal deadline. To avoid the next renewal, cancel at least 24 hours before the current period ends and follow the deadline shown by your store. Price changes and any required notices or consent are handled under the applicable store rules and law. No free trial is included unless explicitly offered at checkout.

Cancellation and Account Deletion

Manage or cancel your subscription in the Apple or Google account where you purchased it. Chunkr provides a management link when available. You can also follow Apple’s cancellation instructions or Google Play’s cancellation instructions. After cancellation, ad-free access normally continues until the end of the paid period; refunds, payment reversals, or other store entitlement changes may end access earlier. Ads may resume after ad-free access expires.

Deleting the app or your Chunkr account does not automatically cancel your store subscription. Cancel through the purchasing store before deleting your account if you want to stop future renewals. Cancellation stops future renewals; it is not itself a refund request.

Restoring Access

Subscriptions are associated with the Chunkr account used for the purchase. To restore access, sign in to that Chunkr account and use Restore purchases, with the purchasing Apple or Google account available on your device where needed. Restoration does not create a new purchase or promise a transfer to a different Chunkr account. Contact [email protected] if access is missing. RevenueCat helps us validate purchases and manage access as described in our Privacy Policy.

Refunds and Platform Terms

For purchases processed by Apple or Google, request a refund through the purchasing store. Eligibility and processing are governed by the applicable store rules and law. Nothing in these Terms limits mandatory consumer rights. Apple and Google billing terms also apply to purchases through their platforms. For the iOS app, Apple’s Standard Licensed Application End User License Agreement also applies.

9. Disclaimers

Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

Availability

We do not guarantee that the Service will always be uninterrupted, error-free, secure, or available in every location.

Third-Party Services

The Service may link to or depend on third-party services. Chunkr is not responsible for those third-party products, content, policies, or failures.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHUNKR’S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

CAD $100; or
the amount you paid directly to Chunkr in the 12 months before the event giving rise to the claim.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHUNKR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Homie Lab Inc. and its affiliates, officers, directors, employees, and agents from claims, losses, liabilities, and expenses arising out of:

your use of the Service;
your User Content;
your violation of these Terms; or
your violation of another person’s rights.

12. Dispute Resolution and Arbitration

Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, excluding conflict-of-law rules.

Arbitration

Except where prohibited by law or where a claim may be properly brought in small claims court, disputes arising out of or relating to these Terms or the Service may be resolved through binding individual arbitration.

No Class Actions

To the fullest extent permitted by law, you and Chunkr agree to bring claims only on an individual basis and not as part of a class, collective, or representative action.

Opt-Out

If applicable law allows an opt-out, you may opt out of this arbitration provision by sending written notice within 30 days of account creation to [email protected], including your name, account email, and a clear statement that you are opting out of arbitration.

13. Termination

Your Right to Stop Using Chunkr

You may stop using the Service or delete your account at any time. See the Privacy Policy, Section 12, for account deletion instructions. Any store subscription must be canceled separately as described in Section 8.

Our Right to Suspend or Terminate

We may suspend or terminate access to the Service, with or without notice, if:

you violate these Terms or our policies;
your behavior creates safety risk;
we suspect fraud or illegal activity; or
termination is otherwise permitted by law.

Effect of Termination

When an account is terminated:

your right to use the Service ends immediately; and
provisions that should survive termination will remain in effect, including sections on liability, indemnity, dispute resolution, and intellectual property.

14. General Terms

These Terms, together with the Privacy Policy and other policies referenced in the Service, form the full agreement between you and Chunkr concerning use of the Service.

If part of these Terms is found unenforceable, the rest will remain in effect.

Chunkr’s failure to enforce a provision is not a waiver of that provision.

We may assign our rights and obligations under these Terms. You may not assign yours without our consent.

We are not responsible for delays or failures caused by events beyond our reasonable control.

15. Changes to These Terms

We may update these Terms from time to time. Material changes may be communicated through the app, by email, or on the website.

Continued use of Chunkr after an update means you accept the revised Terms. If you do not agree, stop using the Service.
